Leave of Absence in the Event of Death

The Act respecting labour standards allows an employee to be absent from work for :

One day without reduction of salary and 4 other days without salary if he/she wishes for the death or funeral of a spouse, child or child of a spouse, father, mother, brother or sister.

One day without pay
On the death or funeral of a son-in-law, daughter-in-law, grandparent or grandchild, or the father, mother, brother or sister of a spouse.

Note: Leave may vary if the person is governed by the Canada Labour Code or has a collective agreement.

DEATH OR FUNERAL FOR THE EMPLOYEE

In the event of the death or funeral of a family member, the employee is entitled to a different number of days of absence.

On the death of :

  • of his/her spouse;
  • of his child or his spouse's child;
  • of his father, mother, brother or sister.

An employee who is not in the garment industry is entitled to the following leaves of absence:

  • one day with pay and 4 days without pay.

Upon the death :

  • of a son-in-law;
  • of a daughter-in-law, of one of her grandparents or of one of her grandchildren
  • the father, mother, brother or sister of the employee's spouse.

The employee is entitled to: one day without pay.

DEATH OR FUNERAL FOR THE EMPLOYEE IN THE CLOTHING INDUSTRY

Upon the death :

  • of the spouse, of a child, of the child of the spouse;
  • father, mother, brother, sister.

The employee is entitled to: 3 consecutive days with pay and 2 days without pay.

Upon the death :

  • of grandparents, father or mother of spouse;
  • of a son-in-law, daughter-in-law, grandchildren or a brother or sister of the spouse.

The employee is entitled to :

1 day's pay.
