When a person dies, it is necessary to verify the existence of a will and to ensure that the latest version is on hand. This information can be obtained by checking with the Registres des dispositions testamentaires et des mandats du Québec (RDTMQ). The will is then systematically searched in the register of the Chambres des notaires du Québec and in the register of the Barreau du Québec.

The will is then systematically searched in the registers of the Chambres des notaires du Québec and the Barreau du Québec.

Two search certificates are then issued, identifying the last will registered in the RDTMQ, if applicable, as well as the name and contact information of the notary or lawyer who received the document. A certified copy of the will is then given to the applicant, with the original retained to ensure confidentiality.

Wills that are notarized or filed with a lawyer are automatically registered in the RDTMQ. However, in the case of a holographic will or a will made in the presence of witnesses, the testator must ask a notary to file it. The authenticity of these documents must be verified following the death of the testator.

Otherwise, if the location of the will is not known, a thorough search of the deceased's personal belongings may be conducted.

SEARCH OF THE WILL OF A LIVING PERSON

The will of a living person cannot be traced, even if the person is incompetent or terminally ill. Only the testator or a person with his or her authorization, given in a notarial deed or in front of 2 witnesses, can obtain a copy.
